Prime Minister's Office Take Action Againt Speak Asia

Speak Asia is a Singapore based market research company that organizes online surveys for various products and companies. It launched it's services in India sometime back and there are a number of ads you see on TV and newspapers.

The Reserve Bank of India (RBI) and the Income-Tax (I-T) department have already initiated investigation against Speak Asia and bank accounts of the company's franchisees have been frozen.

The Reserve Bank of India (RBI) is investigating the operations of the online survey company, which was promising Rs500 a week for just filing online surveys. The investigation would mainly look into financial irregularities, money collection and remittances abroad. Meanwhile, other pyramid schemes are also making headlines with regularity.

Recently, the Prime Minister's Office (PMO) forwarded the complaints filed by Kirit Somaiya, former member of parliament (MP) and national secretary of the Bhartiya Janata Party (BJP) along with the complaints of party MPs Prakash Javdekar and Hansraj Ahir, to the home secretary, finance secretary and ministry of corporate affairs (MCA). In a release, Mr Somaiya said the MCA and the Securities and Exchange Board of India (SEBI) have intimated him that they have started an inquiry and investigation into the functioning of Speak Asia.

Moneylife and its affiliate Moneylife Foundation, a not-for-profit organisation which promotes financial literacy, had sent a representation, dated 17 May 2011, to the prime minister, urging him to completely ban MLM companies in India or to bring them under the regulation of either the RBI or SEBI. We also requested urgent intervention to investigate Speak Asia for the ambiguities prevailing over its business model and source of funding.

Moneylife columnist Veeresh Malik also filed a Right to Information (RTI) query on 14th June with the PMO, seeking to know the action taken on the representation sent by Moneylife.

The ministry of corporate affairs had earlier said that it would not take any action against the survey company. "Speak Asia is not registered in India so we cannot initiate any investigation against it. MCA does not have any database of the company," corporate affairs secretary DK Mittal had told media persons.

Experts point out that since the PMO has also forwarded the complaints to the ministry of corporate affairs, it remains to be seen what action the ministry will take, as they had earlier shown their inability to initiate any investigation.

VIJAYAWADA: The CID police officials conducted surprise checks on the houses of franchisees of one online company Speak Asia in city and arrested two persons for allegedly indulging in illegal activities without having registration under the Companies Act 1956. The police acted on a complaint received from the Hyderabad-based Corporate Fraud Watch about the alleged illegal multi-level marketing activities started by Speak Asia, which was stated to be originally located in Singapore. They arrested D. Srinivas Reddy and L.V.A. Swamy in this connection and seized laptops, desktops, bank pass books and other material pertaining to the marketing activity. The modus operandi was stated to be that the company collects Rs. 6,000 to Rs. 11,000 for getting registered at Speak Asia. The registered person would be sent two surveys every week and gets Rs. 500 per each survey. Besides this, members would get referred income if they get others to enrol as new members.

CID SP Mahendra Kumar Rathod appealed to the public not to believe in deceitful promises being made by such companies.

Raipur: The Speak Asia, Asia’s largest community of sovereign consumers, has washed its hand from the scheme that promised return of Rs 4000 a month and share of profit on an investment of Rs 11000.
Giving a shock to the number of investors, CEO of Speak Asia Tarak Vajpayee on Sunday told that the company had never launched any such scheme.   
Talking the investors, Vajpayee said that the company is just involved in online business. “Those who give business will get return,” said Vajpayee.
"We do not say or believe that anyone can pay us Rs 11,000 and earn X amount of rupees. That is not our promise."
After media investigation into the false claims made by the firm, Vajpayee had earlier apologised for misleading subscribers.
For over a year now, the company has been collecting large sums of money, rapidly luring and enrolling lakhs of people all the time, assuring them of phenomenal returns, while all that they had to do was simply fill out some online surveys.
But suddenly Speak Asia is backtracking on all its get rich quick claims.
The latest development is bad news for over 19 lakhs people who have signed up and paid money to Speak Asia in the hope that it would multiply.
The police have already begun tightening the noose on the agents of Speak Asia, which has till now
accumulated more than Rs 100 crore from people in Raipur and other cities in the state.

Speak Asia talks of exit option to subscribers

Speak Asia, the survey-driven website, in the news for taking a hefty entry fee from people with the promise of it being a very good investment, appears to be retreating under the scrutiny.

It charges Rs 11,000 as an enrollment fee, with a promise that this money can be more than recouped by responding to their surveys, each response getting you money.

People who have put in money under the impression that they are paying to participate in lucrative surveys may be allowed an exit option to redeem their investment, their legal adviser said here on Friday.

The main product of the company is the internet magazine. People paying money are buying the subscription of the magazine. I agree some people have been misguided. I will recommend the company to give these people an exit option,” Ashok M Saraogi, the adviser, said at a press conference.

“Even I don’t want people to lose money. If they are a genuine company, they will go by my advice. I am sure they will agree to my recommendations.”

He expected the company to come up with these announcements within a week. According to him, the fee-based surveys, which the company has been marketing as a lucrative work-from-home opportunity, are only additional benefits offered to the subscribers of the magazine. “There is nothing illegal. There is no restriction on an internet business from operating out of a foreign country,” he said.

peak Asia is not registered with any regulatory authority of India. Critics say the company has been smartly structured to exploit the gaps in various financial sector regulations in the country. There are at least seven financial sector regulators in the country at the last count, but none of these appears to have any jurisdiction over subscriptions received by an online media company, which offers survey as an additional benefit, say legal experts.

What could put Speak Asia in trouble is the apparent intention. Said Saurabh Agarwal, director, Kennis Group, a financial consultancy. “If you are running an online survey business, there is no problem with that. But when you link it with payment of a fee, which is not small, the intention does not seem good”.
“Typically, in these schemes, they will stop paying on one pretext or the other. Having paid the money upfront, the subscriber is left with little choice,” he added.

Neither the company website nor its advertisement campaigns projects Speak Asia’s interests in online publishing. All along, it has marketed itself as an “earn from home” online survey company.

The company’s financial transactions involve a series of transfers through a complex web of holding companies and subsidiaries, according to experts. While money has been collected in the name of Speak Asia Singapore Pte Ltd, payments received by the company’s customers are from other group companies like Haren Ventures, etc.

The company’s website does not give any detail about its associate companies or subsidiaries. Saraogi said disclosures to this effect will be made on the website soon. “We would have made fund transfers to some associate companies. These cannot be termed as siphoning. These are transactions which every company does for accounting reasons,” he said.

Saraogi said the company operated through accounts with ICICI Bank and ING Vysya Bank in India.
Investor forums have asked agencies like Reserve Bank of India, Securities and Exchange Board of India and other regulatory agencies to inquire into the remittances made by the company, including the role of banks

PAN Card Mandatory For Panellists

With  the launch of New Website ALL panelists (Existing and New Both) will need to attach the following to their SpeakAsia Account

• Id Proof - PAN Card
• Address Proof - The acceptable documents will be announced soon.

If you do not have a PAN Card yet, ensure you apply for it TODAY itself. It takes almost a month to get a new PAN Card done if there is no pending document or errors seen. Keeping this in mind, SAOL will be giving a relaxation period on one month after the launch of new website in order to attach your PAN card.
